Lowey Dannenberg said it filed what it described as the first consumer class action against Hims & Hers Health on behalf of users of the company's telehealth platforms, following an October 2023 FTC (U.S. consumer protection agency) investigation that led to a July 29, 2026 civil enforcement complaint by the FTC, the People of the State of California and the Utah Division of Consumer Protection. The law firm alleges Hims & Hers misrepresented its privacy practices, shared sensitive health information with advertisers without consent, and used deceptive billing that turned supposed free consultations into recurring prescription subscriptions. Lowey said its investigation remains ongoing and that the suit seeks damages, restitution and injunctive relief.
