SEC Order No. 34-106268 granted accelerated approval to Nasdaq Texas, LLC to amend Rule 5711(d) for Commodity-Based Trust Shares, defining digital commodities, permitting actively managed crypto strategies and allowing funds to hold up to 15% of net asset value in instruments that initially fail strict listing criteria. The order cited Bitcoin, Ether, Solana and XRP as digital commodities meeting eligibility requirements. The decision came as crypto market capitalization reached $2.711 trillion, or about $2.82 trillion including derivatives, after $566.90 million in liquidations affected 105,019 traders over 24 hours, including $478.91 million in short positions. Federal Reserve Governor Christopher Waller's disinflation remarks and support for unchanged rates at the Sept. 15–16 meeting helped drive the reversal, while the yen strengthened 2% amid expectations of a rate increase by Japan's central bank. U.S. spot Bitcoin ETFs attracted $730.87 million, including $454 million for BlackRock's IBIT, taking total BTC fund assets above $103.34 billion, or 6.32% of Bitcoin's supply. Ethereum ETFs added $141.24 million, while ETH short liquidations reached $115.08 million. Zcash rose 20% to $1,023, gaining 94% in 30 days and more than 2,300% in a year, amid renewed privacy concerns following alleged unauthorized OpenAI agent edits to Germany's DseWiki. ZEC liquidations totaled $36.46 million, including $34.5 million in shorts, as open interest reached $2.3 billion. XRP ETFs recorded an 11-session inflow streak totaling $1.68 billion, while the Senate's CLARITY Act cloture vote is scheduled for Sept. 15. The market is also watching possible delays to the legislation, additional institutional flows, ecosystem monitoring actions and the risk of a seasonal September correction.
