Kelly Armstrong joined industry and economic development groups in opposing Senate Bill 2406, which would further restrict public officials and agencies from signing nondisclosure agreements (NDAs) with data-center developers and other industrial projects. If passed, the bipartisan bill could make a developer ineligible for agency actions such as permits or zoning changes, and a permit could later be revoked if an NDA violation were found. Armstrong supported an amendment by Rep. Jonathan Warrey, R-Casselton, clarifying that agencies could protect information already considered confidential or exempt from disclosure under state law. The bill will be considered when the North Dakota Legislature begins a special session Wednesday, following committee testimony Tuesday. Supporters say the measure gives existing open-records requirements stronger enforcement and greater transparency for communities, while opponents warn that a paperwork violation could disrupt projects and affect public entities such as the Bank of North Dakota.
