The U.S. Senate is under pressure to act on the CLARITY Act before the August 2026 recess, but the digital-asset market structure bill remains stalled with no floor vote scheduled and uncertainty over final revised text. Senator Cynthia Lummis has emphasized that the measure would require regulated digital-asset intermediaries to treat customer cash and crypto as customer property, segregate those assets from company property, and generally bar unauthorized use, aiming to keep them out of a failed platform’s bankruptcy estate. TRON DAO policy executive Adrian Wall separately said delay could push crypto business to more favorable jurisdictions outside the United States. H.R. 3633 passed the House on July 17, 2025, by a 294-134 bipartisan vote, cleared the Senate Banking Committee on May 14, 2026, by 15-9, and was placed on the Senate calendar on June 1, 2026, but its Senate path remains uncertain as leaders seek 60 votes amid unresolved ethics-related issues and criticism from some Democrats that consumer protections are insufficient.
