The U.S. Securities and Exchange Commission has opened a public comment period on Cboe BZX’s proposal to list and trade six daily 3x leveraged ETFs, including a 3x Bitcoin ETF and a 3x Ether ETF alongside products tied to gold, silver, crude oil and natural gas. The filing, SR-CboeBZX-2026-065, was issued as Release No. 34-106137 with an SEC issue date of Aug. 14, 2026, reached the Federal Register on Aug. 19, 2026 as document 2026-16854 (91 FR 53686), and sets comments due Sept. 9, 2026. Cboe submitted the proposal on Aug. 10, 2026 for six VS Trust commodity-pool products; the crypto funds would seek three times the daily performance of first- and second-month CME bitcoin and ether futures through daily resets rather than holding spot assets. Because leveraged products fall outside BZX Rule 14.11(e)(4)(F) generic listing standards, the funds require case-by-case SEC review. Opening comments is procedural and does not signal approval; within 45 days of Federal Register publication, extendable to 90 days, the Commission must approve, disapprove, or institute proceedings. As the window opened, bitcoin traded near $78,619 with a market capitalization around $1.58 trillion.
