Guardant Health must pay more than $245.2 million to TwinStrand Biosciences and the University of Washington after a Delaware federal court finalized a November 2023 jury verdict finding willful infringement of two Duplex Sequencing patents. The award comprises an $83.4 million jury verdict through mid-2023, $19.5 million in post-trial damages through early 2024, $119.4 million from a court-ordered 6% royalty through May 2026, and $22.9 million in calculated interest. The ruling covers 11 products and services that represented about 90% of Guardant's revenue during the infringement period, including Guardant360 CDx, Guardant Reveal, the Shield cancer test and other cancer testing and genomics services. Guardant must provide quarterly accounting reports and continue paying a 6% royalty on the contested products until the patents expire in March 2033, while unpaid balances will continue accruing interest. The court rejected Guardant's counterclaims and request for a new trial and upheld the validity of the patents. Separate administrative reviews remain active at the U.S. Patent and Trademark Office, but neither patent is currently under review for invalidation. Guardant shares were down 3.29% at $165.07 at the time of publication on Monday.
