Brazil’s data protection authority, ANPD, fined TikTok owner ByteDance 153.8 million reais ($29.81 million) for allegedly violating the country’s General Data Protection Law. The authority said TikTok processed personal data from children and teenagers, potentially affecting at least 8 million young users, across logged-in accounts and guest browsing sessions without a valid legal basis or adequate safeguards. ANPD cited systemic weaknesses in TikTok’s age-verification mechanism, including its logged-out feed, which allows users in Brazil to browse content without creating an account and bypassing registration-based checks. The ruling orders TikTok to erase data collected illegally and develop a comprehensive youth-protection framework. ByteDance can appeal within 10 days. The decision adds to Brazil’s growing regulatory scrutiny of online platforms, following ANPD’s order earlier this month for Discord to suspend livestreaming features after concerns over children’s exposure to harmful content. Brazil’s government under President Luiz Inácio Lula da Silva and the Supreme Court have pursued tighter regulation of minors’ internet use as Australia, Canada, Indonesia and other countries consider or implement similar measures.
