Arbitrators accepted Gemini's position that it acted as an agent connecting users to Genesis rather than the direct lender. Earn users recovered their principal in full via in-kind distributions, with more than $2.18 billion in assets returned to members in May 2024, equating to a 232% recovery based on values when withdrawals stopped. The Earn program had advertised yields of up to 7.4%. Separate arbitrations over unpaid interest remain pending, as the SEC dismissed its enforcement action in January 2026 after the full recovery. Gemini had paid fines and settlements totaling tens of millions of dollars with regulators.
