Jurisdiction is the central dispute in a U.S. class-action lawsuit over Coupang’s data breach, with Judge Ann M. Donnelly questioning whether the case should proceed in the Eastern District of New York or South Korea. Plaintiffs argue that Coupang Inc., the Delaware-incorporated U.S. parent listed on the New York Stock Exchange, exercised influence over its Korean subsidiary and disclosed the breach to the U.S. Securities and Exchange Commission. Coupang is seeking dismissal, saying the breach occurred on its Korean platform, involved Korean consumers and was carried out by legally separate Coupang Corp. Daeryun Law Firm and its U.S. partner SJKP filed the case on behalf of two New York-area lead plaintiffs, seeking $5 million in damages; about 7,800 people have expressed interest in joining. The company disclosed in November of last year that data from 33.7 million users had been compromised. The court ordered additional written arguments by Oct. 6 before deciding whether further hearings or other proceedings are needed.
