Britain’s Serious Fraud Office, Dechert LLP, David Neil Gerrard and Eurasian Natural Resources Corporation Limited have concluded proceedings under confidential terms, resolving litigation stemming from the agency’s investigation of ENRC. The SFO examined suspected bribery and corruption connected to mining assets in the Democratic Republic of Congo and elsewhere between 2013 and 2023, but closed the investigation without charges because of insufficient admissible evidence. The High Court found that the SFO breached its duties by engaging with and taking unauthorised information between 2011 and 2013, and that the investigation would not have opened without that conduct. ENRC brought claims against its former lawyers in 2017 and the SFO in 2019. The agency’s Director of Legal Services, Matthew Wagstaff, said the SFO had since introduced stronger governance, independent oversight and clearer safeguards.
