Pro Football Hall of Fame running back Emmitt Smith and his business partners have been sued in Delaware over an alleged $2.5 million investment loss tied to the planned Project Exodus solar farm in Texas. Kituwah LLC, the investment and economic development arm of the Eastern Band of Cherokee Indians, says money it loaned in 2023 was instead used to repay Wilson Holdings, a company also named as a defendant. Kituwah alleges it relied on false projections and data, was promised repayment within months and has recovered no reimbursement since the loan became due on Feb. 1, 2024. The lawsuit seeks at least $2.5 million, interest, expenses, additional damages and attorneys’ fees, and alleges fraudulent inducement, breach of fiduciary duty and breach of contract. Smith, who is 57, won three Super Bowl championships with the Dallas Cowboys, retired after the 2004 season with 18,355 career rushing yards and entered the Pro Football Hall of Fame in 2010.
