Medytox has increased its damages claim against Daewoong Pharmaceutical from 50 billion Korean won to 500 billion Korean won, or approximately $369.6 million, in an ongoing appeal at the Seoul High Court. The company said the amendment incorporates sales and revenue data for allegedly infringing products from 2014 through July 31, 2025, an extended damages period and enhanced damages provisions under South Korea’s Unfair Competition Prevention Act. Damages arising after July 9, 2019, may qualify for up to treble damages, while those arising after August 21, 2024, may qualify for up to five times damages; the court will decide whether and how the provisions apply. Medytox submitted the 500 billion won figure as an explicit partial claim and excluded damages arising after August 1, 2025, so it is not a final court award. The dispute, which began in 2017, concerns allegations that Daewoong misappropriated Medytox’s botulinum toxin strain and manufacturing process for Nabota. A first-instance court ordered Daewoong in February 2023 to pay 40 billion won, approximately $29.6 million, and deliver the relevant strain. Both companies appealed, and the expanded issues could prolong the Seoul High Court proceedings. Related U.S. litigation ended in a settlement involving Medytox, AbbVie and Evolus, while Daewoong was excluded from that agreement.
