Unicoin, formerly TransparentBusiness Inc. and now operating as Unicoin Inc., filed a Sept. 8 lawsuit against Uniswap Labs in the U.S. District Court for the Southern District of New York, seeking declarations that its UNICOIN marks, unicorn logo and domains do not infringe Uniswap's UNI, UNISWAP or UNICHAIN marks. The complaint also seeks cancellation of Uniswap's UNI trademark registration, arguing that UNI is a common Latin-derived prefix used in thousands of U.S. trademark registrations and by multiple crypto projects and tokens. Uniswap's counsel sent three demand letters between June and August, requiring Unicoin to stop using UNI-formative names, transfer unicoin.com and unicoin.org, account for revenue and profits, and pay legal fees. Unicoin argues that its marks, domains and angular unicorn logo are distinct from Uniswap's branding, and says the companies' extensive marketing has not produced known consumer confusion. The suit comes amid Unicoin's unresolved SEC fraud case and ahead of a planned September offering referenced in the complaint. Uniswap has not answered the lawsuit, and Unicoin has requested a jury trial and attorney fees.
