Hims & Hers Health faces a securities fraud class action in the U.S. District Court for the Northern District of California over allegations involving consumer health information, prescription charges, subscription cancellations and related disclosures. Kaplan Fox & Kilsheimer LLP said the case was filed on behalf of investors who purchased or acquired Hims & Hers securities between August 4, 2025, and July 29, 2026. The allegations follow a July 29, 2026, lawsuit against the company by the Federal Trade Commission, the People of the State of California through Los Angeles County Counsel and the Utah Division of Consumer Protection. The government action alleges that Hims & Hers did not clearly disclose that it charged consumers for prescriptions almost immediately after intake forms were submitted, made subscriptions difficult to cancel and misled consumers about protecting their health information. The FTC also alleges that Hims shared consumers’ health information with Meta, Snap and other third parties. HIMS shares fell $4.32, or 14.73%, to close at $25.00 on July 29. Investors have until November 2, 2026, to seek lead plaintiff status, although doing so is not required to participate in any potential recovery.
