A proposed settlement has been reached in a class action against Johnson & Johnson Consumer Inc., now known as Kenvue Brands LLC, over allegations that it collected, stored, disclosed and profited from biometric identifiers or biometric information obtained during Skin360 skin assessments without required written disclosures and consent. The case, Helene Melzer, et al. v. Johnson & Johnson Consumer Inc., No. 3:22-CV-03149, is pending before the United States District Court for the District of New Jersey and the Honorable Michael A. Shipp. The court has preliminarily approved the settlement, which is not an admission of wrongdoing; Kenvue Brands LLC denies violating the law. Eligible class members are people who used any version of Skin360, including Neutrogena Skin360, NeoStrata Skin360 and collaborations, through a mobile or web application while in Illinois from December 9, 2019, through May 5, 2023. The proposed $4.7 million Settlement Fund would cover equal payments to each eligible person who submits a timely, valid claim, as well as notice and settlement-administration costs, court-approved attorneys' fees, expenses and service payments. The final payment amount depends on the number of valid claims and amounts approved by the court. Claims must be filed by November 25, 2026. Class members may instead exclude themselves or object by November 10, 2026. The final hearing is scheduled for December 17, 2026, at 10:00 a.m. in Trenton, New Jersey. The settlement also requires prospective relief from the defendant, as detailed in the settlement documents.
