The final version of the CLARITY Act gives miners and validators clearer statutory protection from being treated as money transmitters when validating transactions or operating network infrastructure. Released by Sens. Cynthia Lummis, John Boozman, and Tim Scott on September 13–14, the bill is scheduled for a Senate cloture vote on September 15, requiring 60 votes to end debate and advance it to formal floor consideration. The sponsors say the text incorporates more than 120 Democratic demands. It also requires covered officials with significant crypto holdings to divest or use a blind trust, adds a Treasury circuit breaker for stablecoin yield arrangements, narrows the BRCA safe harbor by removing explicit Section 1960 criminal protections, and tightens rules on exchange affiliate trading and conflicts of interest. Polymarket raised the bill’s odds of becoming law to 31% from 22% after the final text was released, while Galaxy Research had put passage odds at 30% when the merged July draft appeared. The vote is the first procedural test of the final bipartisan language after the Senate shelved the bill in late July for failing to secure cloture.
