Block & Leviton is investigating Fluence Energy, Inc. for potential securities law violations related to disclosures about its manufacturing ramp and production capabilities. Fluence cut its fiscal 2026 outlook on Aug. 5, 2026, after production and construction delays pushed approximately $400 million of expected deliveries into fiscal 2027. On Sept. 16, Fluence reduced its forecast again, projecting approximately $2.4 billion in fiscal 2026 revenue and an adjusted EBITDA loss of approximately $200 million, citing continued delays at its Houston manufacturing facility. Fluence also appointed Bernerd Da Santos as executive vice president and chief operating officer as it reorganized operations. The investigation will examine whether Fluence adequately disclosed the extent of the manufacturing problems before the guidance reductions. Investors who purchased Fluence common stock and suffered losses may be eligible to contact Block & Leviton, which said it may seek to recover losses through litigation.
