The U.S. Commodity Futures Trading Commission has extended conditional no-action relief for passive technology providers that connect users to regulated derivatives markets without acting as introducing brokers. The expansion follows Staff Letter No. 26-09, issued by the agency's Market Participants Division on March 17, 2026, which granted Phantom Technologies relief tied to its non-custodial wallet. Providers must not custody customer assets, generate trading signals, exercise discretion over order routing or execution, or intervene in individual trades. Users must transact directly with registered designated contract markets or futures commission merchants, while providers must disclose the regulated entities handling their orders. The relief excludes activities involving decentralized finance protocols and unregistered prediction markets. Eleanor Terrett, host of the U.S. podcast "Crypto in America," said the broader measure provides regulatory clarity for the crypto market.
