Netlist Inc. shares rose after the U.S. International Trade Commission (USITC) voted on Sept. 23 to launch investigation 337-TA-1523 under Section 337 into Micron Technology and other companies over alleged infringement of Netlist patents covering DRAM devices and products built with them. Netlist, a memory supplier based in Irvine, California, filed its complaint on Aug. 11 and a supplement on Aug. 25, naming Micron Technology, Micron Semiconductor Products, Hewlett Packard Enterprise, Lenovo Group, Lenovo's U.S. subsidiary, and Super Micro Computer as respondents. Netlist is seeking a limited exclusion order and cease-and-desist orders that could restrict imports or sales of the affected products in the United States. The vote does not determine whether Netlist's claims are valid. The USITC's Chief Administrative Law Judge will assign the case to an administrative law judge, who will oversee an evidentiary hearing and issue an initial ruling. The full commission must review that ruling before it becomes final. The commission has 45 days from Sept. 23 to set a target completion date. Any penalties would take effect immediately but become permanent only after a 60-day period, during which the U.S. Trade Representative can override the outcome on policy grounds. Netlist shares were up 12.74% at $5.94 at the time of publication Wednesday, according to Benzinga Pro.
