The U.S. Commodity Futures Trading Commission’s Division of Market Oversight warned that mention markets face elevated manipulation risk when a contract’s outcome depends on a named person’s words, appearance or interaction. The September 22 staff advisory says regulated exchanges should treat such contracts as potentially readily susceptible to manipulation unless they can provide a stronger, contract-specific account of verification, insider restrictions, surveillance and other safeguards. The guidance is a nonbinding staff view and does not prohibit the products. Kalshi continued to list mention markets after the advisory, including contracts tied to Donald Trump’s remarks at Xi Jinping’s state arrival, Treasury Secretary Scott Bessent’s television interview and BlackBerry’s next earnings call. The CFTC’s recent settlements with Gabriel Perez and former Rep. George Santos illustrate separate risks from advance knowledge of an outcome and a subject’s ability to influence it.
