Australia’s crypto firms covered by ASIC’s sector-wide no-action relief must apply for, or seek a variation to, an Australian Financial Services licence by Sept. 30 when their digital asset products or services fall under existing financial services law. Businesses seeking an Australian Market Licence or a Clearing and Settlement facility licence must instead notify ASIC in writing and hold a pre-application meeting by the deadline. From Oct. 1, firms that require authorization but fail to meet the relief conditions could breach financial services law and face civil or criminal penalties, including fines of up to 10% of annual turnover. More than 45 businesses have sought relevant authorizations since ASIC updated its INFO 225 guidance in October 2025. The temporary protection does not constitute a licence or exemption. A separate statutory framework for digital asset platforms and tokenized custody platforms is scheduled to begin on April 9, 2027, and some existing authorizations will remain necessary.
