Democratic and Republican senators have reached a long-sought agreement aimed at accelerating energy and infrastructure construction while limiting the costs data centers impose on electricity consumers. Sens. Shelley Moore Capito (R-W.Va.), Mike Lee (R-Utah), Sheldon Whitehouse (D-R.I.) and Martin Heinrich (D-N.M.) announced the deal Wednesday and said they expect lawmakers to vote during the lame-duck session after the election. Heinrich said the text would require data centers to pay for the additional electricity costs they create for the grid instead of shifting those costs to consumers. Capito said the agreement would make comprehensive reforms to environmental reviews and permitting under the National Environmental Policy Act (U.S. environmental review law). The negotiations also addressed the Trump administration's efforts to hold up renewable energy projects. Whitehouse said the question of returning to regular order for wind and solar projects in the Trump administration remains unresolved, although lawmakers received what he described as a very reasonable opening proposal from the administration.
