The 51st civil division of the Seoul Southern District Court granted separate injunction requests from KOSPI-listed Jooyontech and KOSDAQ-listed Kmpharmaceutical, suspending the effects of their Korea Exchange delisting decisions and preventing liquidation trading until final rulings in the main cases. Senior Chief Judge Kwon Sung-soo said the exchange rules excessively restricted companies by providing no opportunity to file objections or present their cases. The court also questioned the early application of new market-capitalization thresholds of 30 billion won for KOSPI and 20 billion won for KOSDAQ, which were brought forward to July this year from January next year. About 30 KOSDAQ companies face delisting under the tighter requirements, while Pintel, Medicox and several other companies have pursued similar legal challenges. The rulings do not cancel all affected delistings or establish that the companies are financially sound. They have instead increased pressure on regulators and the Korea Exchange to revise objection procedures, transitional measures and a planned pathway for eligible companies to transfer to KONEX.
