Only 10% of congressional staffers surveyed expect digital asset tax legislation to pass Congress by Dec. 31, 2026, according to a Punchbowl News survey. The outlook reflects crypto legislation’s lower priority amid the post-election schedule and a crowded lame-duck session. Senator Cynthia Lummis, a prominent crypto-friendly lawmaker, has also expressed skepticism about passage this year. The House Ways and Means Committee approved the Digital Asset Tax Clarity Act, H.R. 10357, by a 38-5 vote in September. The bill includes de minimis relief for transaction fees of $10 or less, stablecoin provisions and wash-sale rules for digital assets. A related Senate draft introduced by Sen. Steve Daines covers stablecoin payments and wash-sale extensions, while the collapse of the separate Clarity Act in the Senate has further weakened expectations. If the tax bill stalls, the proposed rules and relief will remain unresolved.
