Eddy Alexandre and his company, EminiFX, were ordered to pay more than $288 million after a federal court found they operated a Ponzi scheme. The Commodity Futures Trading Commission (CFTC), the U.S. commodities regulator, won summary judgment in August 2025, resulting in $228.58 million of restitution and $15.05 million of disgorgement. A final judgment on October 8, 2026, added a $45.15 million civil monetary penalty. US District Judge Valerie Caproni also permanently barred Alexandre and EminiFX from commodities fraud and related activities. EminiFX operated from September 2021 through May 2022, attracting more than 25,000 investors, mainly from New York's Haitian-American community. It promised weekly returns of 5% to 9.99% through trading technology that did not exist, raised more than $262 million, and incurred net trading losses exceeding $49 million. Alexandre used funds from newer investors to pay earlier participants and diverted at least $15 million for personal expenses, including luxury vehicles. Separately, he pleaded guilty to commodities fraud in July 2023, receiving a nine-year prison sentence and an order to pay more than $213 million in restitution. A court-appointed receiver had returned about $98.2 million to victims by mid-2026, with another distribution anticipated in 2027.
