Gellert Global Group, a family-run U.S. food business, filed a lawsuit Tuesday in the U.S. Court of International Trade challenging the Trump administration’s 50% tariffs on Canadian goods. The Liberty Justice Center brought the case for the company and a proposed class of importers. The suit argues the administration exceeded its authority under Section 338 of the Tariff Act of 1930, a nearly century-old provision never before used to collect tariffs. Gellert Global is also seeking a ruling that the duties are unlawful and refunds for tariffs it has already paid. The Liberty Justice Center previously contested Trump’s reciprocal tariffs at the Supreme Court.
