The complaint alleges Badger Meter misled investors about the drivers of its record financial results, demand for its products and prospects for continued growth by attributing performance to favorable industry trends, secular growth drivers and solid execution while touting strong demand, robust order pacing, a strong bid pipeline and a long runway for growth. The lawsuit claims the company pulled forward customer orders to recognize revenue early, masking weakening demand and deteriorating near-term order trends and depleting revenue otherwise available for future periods, which later contributed to disappointing results. Rosen said a class action has already been filed, that investors may seek compensation on a contingency-fee basis, and that shareholders can remain absent class members without serving as lead plaintiff.
