A proposed class action settlement would make $15,000,000 available to buyers of certain Bestway-branded above-ground pools tied to an alleged safety defect that creates a potential drowning hazard. The case, filed in the U.S. District Court for the Northern District of Illinois as In re: Bestway Above-Ground Pools Litigation, Case No. 1:25-cv-09570, names Bestway (USA) Inc., Bestway Inflatables & Material Corp., and Bestway (Hong Kong) International Ltd. The agreement is not an admission of liability, does not release claims for personal injury or property damage, and does not alter the July 21, 2025 recall, which remains in effect separately. The proposed settlement class includes people who bought for personal use, not resale, from a store or other commercial retailer, and not second-hand, a Bestway-branded pool 48 inches tall or higher, including Power Steel and Steel Pro models, with compression straps outside the support poles, sold between 2008 and 2024. Eligible class members must submit a claim by October 30, 2026 online or by mail to seek a payment, while the same date applies to requests for exclusion or objections. A final approval hearing is scheduled for November 20, 2026 before the Honorable Lindsey C. Jenkins in Chicago.
