The Hague court said Ceban's pharmacy-made semaglutide nasal spray breached Novo Nordisk's supplementary protection certificate, ordering an immediate sales halt, listing removals, supply-chain disclosure and legal-cost reimbursement.
Novo Nordisk said the District Court of The Hague granted a preliminary injunction against Ceban Ziekenhuisfarmacie B.V. in a patent infringement case involving a compounded semaglutide nasal spray, finding that the product infringed the company's supplementary protection certificate (patent-extension right) covering semaglutide. The order requires Ceban to stop the infringing activity immediately, remove references to the product from relevant listings and websites, provide information on its commercial supply chain and reimburse Novo Nordisk's legal costs. Novo Nordisk said no regulatory authority has approved a nasal spray formulation of semaglutide, that it does not manufacture, distribute or endorse compounded medicines (pharmacy-prepared formulations), and that its approved semaglutide medicines are Wegovy®, Ozempic® and Rybelsus®. Kuckelman, Group General Counsel, Novo Nordisk, said the ruling shows intellectual property rights protecting pharmaceutical innovation will be enforced as the company continues to pursue legal action against unapproved semaglutide products.
